Подходы к формированию "Защитного файла" по коммерческой осмотрительности субъектами малого бизнеса

The article presents the results of the analysis of the concept of "commercial prudence", its necessity at the legislative level and at the level of the organization, the manifestation of due diligence and the concept of "Security file". The differences between the three publications of the letter of the Plenum of the Supreme Arbitration Court (FTS) of the Russian Federation dated 2006, 2017, and 2021 "On the assessment by arbitration courts of the validity of taxpayers receiving tax benefits" are considered. The criteria for proving the concept of "tax security" of organizations are given, with the help of which recommendations were made to improve the methods of forming a "Security file". The results of the analysis can be used by organizations and sole proprietors to comply with tax security and commercial prudence.В статье представлены результаты анализа понятия «коммерческая осмотрительность, его необходимость на законодательном уровне и на уровне организации, проявление должной осмотрительности и понятие «Защитного файла». Рассмотрены различия между тремя публикациями письма Пленума ВАС (ФНС) РФ от 2006, 2017, и 2021 года «Об оценке арбитражными судами обоснованности получения налогоплательщиками налоговой выгоды». Приведены критерии для доказательства концепции «налоговой безопасности» организаций, с помощью которых были даны рекомендации по совершенствованию способов формирования «Защитного файла». Результаты анализа могут быть использованы организациями и ИП для соблюдения налоговой безопасности и коммерческой осмотрительности
